Madam,

Please advise us on the proper way to file leave for Federal Court.

The issues raised will be -

statutory interpretation on the Public Officer's Regulation (Appointment, Promotion and Termination) 2012.

Regulations 29 - Conditions for Confirmation, where the challenged sub regulations 29(7) - whether the word - "The Commission is not bound by the recommendation by the head of department" constitutes the power vested by the Yang Di Pertuan Agung in order to confirm or not to confirm which unfortunately contradicts with Article 136 of the Federal Constitution which endorsed the "impartiality" among the public officer. (if that was the case, the statutory interpretation would become - Conditions for confirmation and the discretionary power to confirm. Furthermore, the subregulation 29(7) is a non obstante clause which overrides the subregulation 2 which clearly stated that the conditions for confirmation must be accompanied by the recommendation of the head of department. Overall, there is no doubt that the Regulation did not emphasize on the Commission's discretionary power to confirm an officer. It is also evident in Article 144 of the Federal Constitution that the Commission's power to terminate an officer was mentioned, but the power not to confirm was never be found. The termination / dismissal must be met by following the Article 135 in s strict manner.

I was recommended by the head of the department, by right they should not discriminate me by not confirming me in my service without just cause and excuse which contradicts the Article 136.
